By entering and/or using this HAMER portal, you agree to the General Terms of Use shown here. These terms will apply independently of any general terms and conditions that must compulsorily be met.

3. Use of the website

hamer-pack.com provides access to a wide range of information, services, programs and data (henceforth, « the contents ») in Internet belonging to HAMER or its licensors to which you as the USER may have access. The USER assumes responsibility for the use of the portal. This responsibility extends to the registration that might be necessary to access certain services or contents. In this registration you undertake to provide true and lawful information. As a consequence of this registration, you may be provided with a password for which you will be responsible and of which you agree to make diligent and confidential use. You hereby agree to make proper use of the content and services (such as, for example, chat services, discussion forums or news groups) that HAMER provides over its portal and agree to not use them to, by way of example but not limited to these, (i) engage in unlawful or illegal activities contrary to good faith and public order; (ii) disseminate content or propaganda of a nature that is racist, xenophobic, pornographic-illegal, supports terrorism or which constitutes an attack on human rights; (iii) cause damage in the physical and logical systems belonging to HAMER, to its suppliers or to other people; enter or disseminate on the Net computer viruses or any other physical or logical systems that could cause the previously mentioned damage; (iv) try to access or use email accounts of other users or change or manipulate their messages. HAMER reserves the right to withdraw any comment or contribution that violates the respect for a person’s dignity, that is discriminatory, xenophobic, racist, pornographic, that threatens young people or children, public order or safety or which, in its judgement, is unsuitable for publication. In any case, HAMER will not be held responsible for the opinions voiced by users in the forums, chats or other participation tools.

4. Data protection

HAMER complies with the guidelines of Organic Law 15/1999 of 13 December on Personal Data Protection, Royal Decree 1720/2007 of 21 December 2007 approving the Organic Law implementing regulation and other regulations in force at all times and strives to ensure the proper use and processing of your personal details. To that end, together with the personal data collection form, in the services you can seek from HAMER you will be informed of the existence and acceptance of the particular conditions of the processing of your details in each case, informing you of the party responsible for the created file, the party’s address, the possibility of exercising your rights of access, rectification, erasure or objection, the purpose of the processing and the reporting of your details to third parties, where applicable. Similarly, HAMER informs you that in compliance with Act 34/2002 of 11 July 2002 on the Information Society and Electronic Commerce you will be asked to provide your consent to the processing of your email for commercial purposes at all times.

5. Intellectual and industrial property

HAMER is the owner or delegated holder of all the intellectual and industry property rights on its website and the elements contained therein (by way of example, images, sound clips, audio, video, software or texts; brands and logos, colour combinations, structure and design, selection of material used, computer programs needed for proper functioning, access and use, etc.) that are owned by HAMER or its licensors. All rights reserved. In pursuance of the provisions in Articles 8 and 32.1, second paragraph, of the Copyright Act, it is expressly forbidden to reproduce, distribute and disseminate publicly, including the making available modality, of all or part of the contents of the webpage for commercial purposes, in any format and by any technical means, without the authorisation of HAMER. You agree to respect HAMER’s intellectual and industrial property rights. You may view the portal elements and print, copy and store them on your computer’s hard drive or any other hardware so long as it is solely and exclusively for your personal and private use. You must refrain from deleting, altering or manipulating any protective device or security system installed in the HAMER pages.

6. Legal disclaimer

HAMER takes no responsibility, under any circumstances, for harm or damage of any kind that may be caused by, but not limited to, the following: errors or omissions in content, lack of availability of the portal or transmission of viruses or programs that are malicious or harmful in their content, in spite of having adopted all the necessary technological measures to avoid such occurrences.

7. Modifications

HAMER reserve the right to make any modifications to its portal it considers appropriate without prior warning and can change, delete or add both the content and services provided over its portal and the way that they are presented or located on it.

8. Links

In the case of the domain name having links or hyperlinks to other Internet sites, HAMER shall not exert any kind of control over those sites and contents. In no case shall HAMER assume any responsibility for the contents of any link belonging to an outside website, nor shall it guarantee the technical availability, quality, reliability, accuracy, scope, veracity, validity or constitutionality of any material or information contained in any of the hyperlinks or other Internet sites. Equally, the inclusion of these external links shall not imply any kind of association, merger or involvement with the linked organisations.

9. Right of exclusion

HAMER reserves the right to deny or withdraw access to its portal and/or services offered with no forewarning, at its own request or that of a third party, to users who fail to meet the current General Terms of Use

10. General matters

HAMER shall pursue lack of compliance with these conditions as well as any undue use of its portal by means of all manner of civil and criminal actions that may be applicable under the Law.

11. Modification of these conditions and duration

HAMER can modify the conditions set out here at any time, being duly published as they appear here. Said conditions will be in effect during the time they are displayed and will be valid until they are modified by other duly published conditions

12. Applicable law and jurisdiction

The relationship between HAMER and the USER shall be bound by current Spanish regulations and any dispute shall be submitted to the courts and tribunals of the city of Barcelona.
